  54. This Limited Use Software License Agreement (the "Agreement") is
  55. a legal agreement between you, the end-user and JESTER SOFTWARE CO. 
  56. By continuing the installation of this game program, by loading or
  57. running the game, or by placing or copying the game program onto
  58. your computer hard drive, you are agreeing to be bound by the
  59. terms of this Agreement.

  64. 1.  Grant of License. JESTER SOFTWARE CO. grants to you the right to 
  65. use the JESTER SOFTWARE CO game program ("GORE GALORE-THE BREAKOUT"), 
  66. which is the shareware version or episode one of the game program.  
  67. For purposes of this section, "use" means loading the Software into
  68. RAM, as well as installation on a hard disk or other storage
  69. device.  You may not: modify, translate, disassemble, decompile,
  70. reverse engineer, or create derivative works based upon the
  71. Software.

  73. 2.  Copyright.  The software is owned by JESTER SOFTWARE CO. 
  74. and is protected by United States copyright laws and international
  75. treaty provisions.  You must treat the Software like any other
  76. copyrighted material, except that you make copies of the
  77. Software to give to other persons.

  79. 3.  Limited Warranty.  JESTER SOFTWARE CO. DISCLAIMS ALL WARRANTIES, 
  80. EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED
  81. WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR

  92. of liability for consequential or incidental damages, so the above

  95. This agreement shall be governed by the laws of the State of
  96. California and shall insure to the benefit of JESTER SOFTWARE CO. and 
  97. successors, administrators, heirs and assigns.  Any action or
  98. proceeding brought by either party against the other arising out
  99. of or related to this agreement shall be brought only in a STATE
  100. or FEDERAL COURT of competent jurisdiction located in Santa Clara
  101. County, Calif.  The parties hereby consent to in personam
  102. jurisdiction of said courts.
